Agreements authorized prior to County Home sale vote

MAYVILLE – The Chau-tauqua County Legislature’s Human Services Committee has unanimously passed a resolution authorizing an asset purchase agreement and escrow agreement between the Chautauqua County Home and its potential purchaser.

The committee met last week to discuss the resolution, which was also presented to the Audit and Control Committee. The resolution grants the County Home and its assets to Dunkirk Realty Holdings, LLC and Dunkirk Operating LLC. The two LLCs would be the owner and operator of the home.

In August, Martin and Edward Farbenblum and Shannon Cayea of Vestra-Care made a presentation to the county legislature, expressing their interest in the home. The group offered $16.5 million for the purchase of the home, which includes property, including all of the land, buildings, gas well, personal property and intangible property, which includes net accounts receivable of $1,299,424.78. The legislature also held a special meeting Oct. 9 for a question-and-answer session with VestraCare.

During the committee meeting, Legislator Mark Tarbrake, R-Ellicott, said he felt the special meeting had gone well, and expressed that he felt VestraCare answered the questions presented to them in a professional, fair manner.

Additionally, Vince Horrigan, R-Bemus Point, questioned the assessed value of the home during the meeting. Steve Abdella, county attorney, said the assessment would be determined by the assessor in Dunkirk.

The legislature will hold a special meeting Oct. 30 for a vote on whether to sell the Chautauqua County Home to VestraCare.

If the Chautauqua County Legislature does not approve the sale by Oct. 31, VestraCare has the right to terminate the agreement.
