Tax collection process tops agenda

A continuation of the tax collection agreement between the city of Dunkirk and Chautauqua County is one of two pre-filed resolutions under consideration today when the Common Council meets at 5:30 p.m. in City Hall.

Resolution 20-2014 would extend an agreement council approved by resolution in July 2010. In December, the County Legislature authorized the county executive to execute an extension of the existing joint tax collection agreement for the 2014, 2015 and 2016 tax levies.

The agreement provides that the collection of city, and Dunkirk School District taxes for properties located in the city, continue to “be equivalent to the collection and enforcement of real property taxes afforded to the towns, villages, and school districts outside the city, including the guarantee of all such taxes.”

Mayor Anthony J. Dolce would be “authorized and empowered” to execute the agreement with the county to cover the 2014, 2015 and 2016 tax collections.

Resolution 21-2014 calls for making two budget transfers to cover 2013 spending. Fund I would see $1,500 moved from the central garage vehicle fuel account to traffic control traffic and street signs. Fund III would provide an additional $8,886 to the wastewater treatment plant lab which comes from contracted services ($5,386) and a repair/maintenance line ($3,500).

Notices of claim were filed by town of Dunkirk resident William Narraway and Slone Melhuish & Co., which insures the county.

The county is seeking $1,265 in damages from a Dec. 31 accident at the North County Transfer Station when a city garbage truck “hit a vehicle and pushed it into the attendant booth,” according to the city’s notice of claim form. Structural damage to the booth’s wood frame and electrical wiring along with reinstallation of service were claimed as the result of the accident. According to the accompanying letter from Slone Melhuish & Co., the city truck was driven by Stephen Zatorski and the city had pictures taken.

Narraway’s claim is for $89.32 in damages to his vehicle caused when he “was attempting to turn on to Smith Street from Willow Road and struck a deep, large pothole in the middle of the street.”

Communications and petitions from the public are for use of city facilities for softball events, along with a loudspeaker application for an event that is part of a city tradition.

Dunkirk Memorial Post 62 Commander John Miga filed the loudspeaker application, seeking permission to have a live band from 3 to 7 p.m. at Post 62’s outside pavilion on May 26. The music, along with a chicken barbecue, were part of festivities held annually at the former Frank Acquavia Post on Memorial Day after the parade.

The First Ward Falcon Club is seeking permission to use city softball fields on May 10 for its Early Bird Fast Pitch Softball Tournament and from July 10 to July 20 for its annual Fast-Pitch Softball Tournament.

The Chautauqua County Exceptional Senior All-Star Baseball/Softball Committee is seeking to use Promenschenkel Stadium on June 19 to hold the annual Exceptional Senior All-Star Softball game.

The softball stadium will see plenty of early use if a school district request is granted. The district is seeking to use Promenschenkel from March 4 to May 30 for practices and games for the modified softball team. In addition, the request from Athletic Director Michael Sarratori asked that the varsity and jayvee teams be allowed to use the field in the event of poor conditions at the DHS field.

Council will also entertain comments from people during its privilege of the floor portion of the meeting. According to council rules, speakers are limited to three minutes unless representing a group, in which case they are allowed five minutes. The rules also state the “chairman shall maintain good order and may require any speaker to cease speaking if remarks are made in bad taste, or are slanderous or not germane to any action taken or contemplated by the council.”
